By accessing our website, making a reservation, or staying at our property, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

2. Reservations and Bookings
2.1 Booking Process
Reservations can be made through our website via our booking platform (Amenitiz) or by contacting us directly. All bookings are subject to availability and confirmation.
2.2 Guest Information
You must provide accurate, complete, and current information when making a reservation. You are responsible for ensuring all guest information is correct.
2.3 Age Requirements
The primary guest making the reservation must be at least 18 years of age. Guests under 18 must be accompanied by a parent or legal guardian.
2.4 Booking Confirmation
A booking is confirmed only when you receive a confirmation email from VidaSoul or our booking platform. We reserve the right to refuse any reservation at our discretion.
3. Payment Terms
3.1 Payment Methods
We accept payment through:
Credit/debit cards (processed via Stripe or our booking platform)
PayPal
Other methods as indicated during booking
3.2 Payment Processing
Payment transactions are processed securely through:
Our third-party booking platform (Amenitiz), or
Directly on our website via Stripe, or
Through PayPal
We do not directly store your payment card information. All transactions are processed through PCI-compliant payment processors.
3.3 Payment Schedule
Payment terms will be specified at the time of booking and may include:
Full payment at time of booking
Deposit upon booking with balance due before arrival
Payment at check-in (for approved direct bookings)
3.4 Currency
All prices are quoted in the currency displayed at the time of booking. Currency conversion rates, if applicable, are determined by your payment provider.
3.5 Taxes and Fees
All rates are subject to applicable Mexican taxes, including IVA (Value Added Tax) and lodging taxes. Additional fees may apply as specified during booking.
4. Cancellation and Modification Policy
4.1 Cancellation Terms
Cancellation policies vary by rate type and season. Specific cancellation terms will be clearly stated at the time of booking. Standard policies include:
Flexible Rate: Cancellation up to 7 days before arrival for full refund
Standard Rate: Cancellation up to 14 days before arrival for full refund
Non-Refundable Rate: No refunds or modifications permitted
Cancellations made after the specified deadline will result in charges as outlined in your booking confirmation.
4.2 Modifications

4.3 No-Shows
Failure to arrive on your scheduled check-in date without prior cancellation will result in a charge for the full reservation amount, and your reservation may be canceled.
4.4 Early Departure
Early departure from the hotel does not entitle you to a refund for unused nights unless otherwise agreed upon at check-in.
4.5 Force Majeure
In cases of force majeure (natural disasters, government orders, pandemics, etc.) that prevent your stay, we will work with you to reschedule or provide appropriate compensation.
5. Check-In and Check-Out
5.1 Check-In Time
Standard check-in time is 3:00 PM local time. Early check-in is subject to availability and may incur additional charges.
5.2 Check-Out Time
Standard check-out time is 12:00 PM local time. Late check-out is subject to availability and may incur additional charges.
5.3 Identification
Valid government-issued photo identification is required at check-in for all guests.
6. Guest Conduct and Responsibilities
6.1 Property Rules
Guests agree to:
Respect other guests and maintain reasonable noise levels, especially during quiet hours (10:00 PM - 8:00 AM)
Comply with all posted property rules and staff instructions
Not smoke in non-designated areas
Not bring illegal substances or weapons onto the property
Not host parties or events without prior approval
Respect the maximum occupancy limits for your room
6.2 Damages
You are responsible for any damage to the property, furnishings, or equipment caused by you or your guests. We reserve the right to charge your payment method for repair or replacement costs.
6.3 Security Deposit
We may require a security deposit or credit card authorization at check-in to cover incidental charges or potential damages.
6.4 Liability for Personal Property
VidaSoul is not responsible for loss, theft, or damage to guests' personal property. We recommend using in-room safes when provided and maintaining travel insurance.
6.5 Right to Refuse Service
We reserve the right to refuse service or require a guest to leave the property immediately without refund if they:
Violate these Terms or property rules
Engage in illegal activities
Create safety concerns or disturbances
Damage property
Behave in a manner deemed inappropriate by management
7. Services and Amenities
7.1 Services Provided
Hotel services and amenities are subject to change without notice. We strive to maintain all advertised services but cannot guarantee availability due to circumstances beyond our control.
7.2 Third-Party Services
Some services or activities may be provided by third-party vendors. VidaSoul is not responsible for third-party services, and separate terms may apply.

While we strive to provide reliable internet access, we do not guarantee uninterrupted service and are not liable for any connectivity issues.

9. Intellectual Property

10.2 Liability Limits
To the maximum extent permitted by Mexican law, VidaSoul's total liability for any claims arising from your stay or use of our services shall not exceed the amount you paid for your reservation.
10.3 Exclusions
VidaSoul is not liable for:
Personal injury or death except where caused by our negligence
Loss or damage to personal property
Force majeure events beyond our control
Actions of third-party service providers
Indirect, incidental, or consequential damages
10.4 Safety and Health
Guests are responsible for their own safety. We encourage guests to:
Follow all posted safety warnings
Use facilities and amenities responsibly
Inform staff of any health conditions that may require assistance
Exercise caution when engaging in recreational activities
11. Indemnification
You agree to indemnify and hold harmless VidaSoul, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your violation of any rights of third parties

Your negligent or intentional misconduct
12. Dispute Resolution

These Terms are governed by the laws of Mexico, specifically the State of Baja California Sur, without regard to conflict of law principles.

12.3 Mediation and Arbitration
If informal resolution is unsuccessful, any disputes shall be resolved through mediation or arbitration in La Paz, Baja California Sur, Mexico, in accordance with Mexican commercial arbitration rules.

You agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits.
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and VidaSoul.
13.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
13.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
13.4 Assignment
You may not assign or transfer these Terms. VidaSoul may assign these Terms in connection with a business transfer or sale.
